Small Business That Beat Take-Two's Trademark Opposition Publishes the Full Account: "BROCKSTAR vs ROCKSTAR" Now on Amazon

Book documents the thirty-mark opposition Take-Two abandoned, the seven coexistence terms its lawyers proposed, and a three-year TTAB record of 125 filings; author says the pattern should concern TTWO shareholders ahead of Grand Theft Auto VI

ROCKY MOUNT, N.C., Nov. 2, 2026 -- BrockStar Media Corp today announced the publication of "BROCKSTAR vs ROCKSTAR: A Fight Against Corporate Trademark Bullies" (paperback, 266 pages, $18.95), the first-person account of how a North Carolina marketing agency answered, and outlasted, a trademark opposition filed by Take-Two Interactive Software, Inc. (Nasdaq: TTWO), the parent company of Rockstar Games.

On November 27, 2024, Take-Two, represented by Kelley Drye & Warren LLP, filed Opposition No. 91295390 at the Trademark Trial and Appeal Board against the agency's application to register BROCKSTAR MEDIA for Class 35 marketing services, pleading thirty ROCKSTAR-family registrations and applications. Founder Carl B. Brock answered the opposition himself on January 20, 2025 and wrote every filing after it. Take-Two withdrew on March 11, 2025. At Brock's motion, the Board dismissed the opposition with prejudice on June 27, 2025, and BROCKSTAR MEDIA registered on July 22, 2025 as U.S. Reg. No. 7,870,392.

"Take-Two's lawyer told me three times in writing that her client was not objecting to my mark, while a thirty-mark opposition against that mark sat on the docket," said Brock. "Then they asked me to sign seven permanent limits, including advance consent to their own filings in my class. I said no to all seven, I said I would challenge their registrations one by one, and two days later they withdrew. The book is the record of that, and then it is the handbook I wish I had on day one."

The book reproduces eight email exhibits, names Take-Two's counsel, and cites more than 400 footnotes to the Lanham Act, the Trademark Rules of Practice, the Board's manual of procedure and the controlling cases. Chapters cover reading an opponent's portfolio, answering a Notice of Opposition on time, counterclaims and petitions to cancel, discovery and proof, and when to fight and when not to.

A three-year enforcement record

Public TTAB records searched on November 2, 2026 show Take-Two Interactive in 125 Board entries filed between September 25, 2023 and October 8, 2026: 39 oppositions and 86 requests for an extension of time to oppose, with Take-Two as the opposer in every one. Recent targets include a sandwich shop's VICE CITY SUBS, the Royal Academy of Dance's stylized letter R, Hazelight Studios' IT TAKES TWO, and the word CIVILIZATION. USPTO records also show Take-Two holds live federal registrations on ordinary words including MAFIA, DOTS, BULLY, CIVILIZATION and GTA, and on the single letter R.

"I have been a Rockstar fan my whole life and I am waiting for Grand Theft Auto VI like everyone else," Brock said. "Fan or no fan, if you let them, they will squash you like a bug. Personally, I think the law firm is the problem. In my opinion it is about justifying billable hours by any means necessary. That is my own view. You would have to ask the lawyers why they went after a mark nothing like their client's, in a class their client does nothing in. Maybe it is a testament to why they trademarked the word BULLY."

Why shareholders should care

Take-Two's fiscal 2026 Form 10-K reports GAAP net revenue of $6,656.4 million and states that Grand Theft Auto VI is planned for release on November 19, 2026. The same filing warns investors that legal proceedings "could be expensive, lengthy, disruptive to normal business operations" and that their outcomes "may be difficult to predict." Brock's analysis for investors, with citations to the 10-K and the Board's docket, is published at https://gta7.news/shareholders/.
